By paying this invoice, the Client agrees to the following Terms and Conditions set by Jen's Fun Faces ("the Artist").
Payment, Cancellation & Weather Policy
A booking fee of 50% of the total booking cost is required to secure all public event bookings. For private bookings, a booking fee may be required at the Artist's discretion. The remaining balance is due 7 days prior to the event date. The booking fee is non-refundable in all circumstances as it secures the Artist's availability and may result in other work being declined.
Should the Client cancel the booking:
More than 14 days before the event: the booking fee will be retained and any additional monies paid will be refunded.
Between 7 and 14 days before the event: 50% of the total booking value will be retained by the Artist.
Less than 7 days before the event, or on the day of the event: 100% of the booking value will be retained by the Artist.
The Artist will make reasonable efforts to accommodate requests to postpone or transfer a booking; however, alternative dates cannot be guaranteed and any transfer remains at the sole discretion of the Artist.
Public events held between May and October must have a suitable indoor venue, weatherproof alternative location, or wet-weather contingency plan available. New Zealand weather can be unpredictable and outdoor events are expected to plan accordingly. If an event is cancelled, postponed, significantly reduced, or unable to proceed due to adverse weather and no suitable alternative venue or contingency plan has been arranged, the cancellation terms above will apply and the Client may forfeit up to 100% of the booking value.
If the Artist cancels due to illness, emergency, or other unforeseen circumstances and a suitable replacement entertainer or alternative date cannot be arranged, all monies paid will be refunded in full.
A minimum booking of 2 hours applies to private events and 3 hours applies to public events during November and December.
Services
The Artist will provide face painting and/or giant bubble entertainment for the agreed booking period and will endeavour to accommodate as many participants as reasonably possible during that time. Additional time may be available by mutual agreement and will be charged at the current rate. The Artist reserves the right to subcontract suitably qualified entertainers where required.
Venue & Working Conditions
The Client must provide a suitable, safe, weather-protected area for the Artist. Face painting requires a minimum 2m x 2m space. If a gazebo is required, this must be arranged in advance and additional charges may apply. Where the Artist provides a gazebo, reasonable efforts will be made to secure it safely; however, the Client accepts responsibility for venue suitability and any insurance requirements relating to its use. The Artist reserves the right to relocate, suspend, or cease services without refund if weather conditions, venue conditions, crowd behaviour, or other circumstances create an unsafe working environment. Any damage to the Artist's equipment resulting from the Client's failure to provide suitable operating conditions may be charged to the Client.
Parking
Suitable parking or unloading access within 20 metres of the venue must be available. Delays caused by lack of access may reduce service time and may not be recoverable depending on Artist availability.
Face Painting
Only professional cosmetic-grade products are used. The Artist is not liable for allergic reactions, and individuals with known sensitivities should request a patch test before painting. Face Paint is not recommended for children under 3 years old, it is the responsibility of the client to be honest about age when requesting a face paint. The Artist will also not pain anyone unable or unwilling to consent, or anyone appearing to have an infectious illness, cold sores, conjunctivitis, open wounds, sunburn, or contagious skin conditions.
Giant Bubble Activities
The Artist may use cones, barriers, ropes, signage, or other visual markers to discourage entry into the bubble area; however, bubble solution can create slippery surfaces. The Client acknowledges that slips, trips, and falls are an inherent risk of giant bubble activities. The Artist is not responsible for injuries, accidents, or damage resulting from participants or spectators entering the bubble area, failing to follow instructions, or coming into contact with bubble solution. The Artist may relocate, modify, pause, or cease bubble activities if conditions become unsafe.
Supervision & Liability
The Artist does not supervise children. The behaviour, safety, and supervision of all children and guests remain the responsibility of the Client, parents, caregivers, or event organisers at all times. The Artist is not responsible for damage to clothing, personal belongings, or property and accepts no liability for injuries caused by the actions of guests, participants, pets, or other attendees. The Client agrees to reimburse the Artist for damage caused to equipment by attendees, pets, or unsafe venue conditions.
Photography
The Artist may take photographs and videos during the event for portfolio, training, website, social media, and promotional purposes. If the Client does not consent to photography, they must notify the Artist in writing prior to the event. The Client is responsible for advising attendees of any photography restrictions.
Force Majeure
Neither party shall be liable for failure to fulfil their obligations due to circumstances beyond their reasonable control, including but not limited to severe weather warnings in place, natural disasters, pandemics, government restrictions, venue closures, utility failures, strikes, or civil unrest. Where possible, both parties will work together to arrange an alternative date.
Extreme Adverse Conditions
The Artist reserves the right to cease services and leave the event without refund if extreme adverse conditions exist and are not remedied after being brought to the Client's attention. Such conditions include, but are not limited to, violent or destructive behaviour, illegal activities, extreme weather, unsafe environments, harassment, or any situation that places people or property at risk.
